Wage & Hour Rights and Responsibilities
Wage Payment: Employee rights include:- Pay for all earnings earned (INFO # 3) at the rate accepted by the company and staff member.
– Pay of a minimum of base pay (INFO # 1), the appropriate Colorado or regional minimum wage, and all made overtime salaries without impermissible deductions from their earnings;.
– Pay of all made incomes without impermissible reductions (INFO # 16).
Labor Statutes, Rules, & Published Guidance
Statutes & Rules: DLSS enforces a lot of Colorado’s wage and hour and other types of labor statutes and labor rules, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards ( » COMPS Order »), and the Equal Pay for Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules webpages for existing and previous variations of key Colorado labor statutes and guidelines.
Published Guidance: The Division’s primary kinds of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s formally authorized notices, viewpoints, referall.us and descriptions on different labor law subjects; and.
– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for workers on their labor rights.
Written Demands, Complaints, & Investigations
Demands & Complaints for Wages: If a company owes you earnings, you can send your company a written demand for payment of earnings by mail, e-mail, text, or other electronic ways. A written need may be sent out to the company at the very same time a Labor Standards Complaint Form for unpaid salaries is filed with the Division. The Labor Standards Complaint Form can be found on our Demands, Complaints, Responses, and Settlements web page.
Employer Responses in Investigations: Once a total Labor Standards Complaint Form is gotten and reviewed, a letter describing the nature of the problem and the quantities alleged to be owed is sent to the employer. Investigations Launched by the Division ( » Direct Investigations »): The Division may carry out employer-wide direct investigations of prospective infractions of Colorado wage and hour law. If you want to send a pointer, please email the Division at cdle_di_tips@state.co.us. If you wish to file a specific claim for overdue salaries, you must submit a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements website. To appeal a direct examination citation or one or more Notices of Assessment, an alleged employer might send a Direct Investigation Appeal Form.
